Terms of Service

The terms that govern our working relationship. Effective May 2026.

These Terms of Service (“Terms”) govern the relationship between NWGA Smart Homes (“Company,” “we,” “us,” or “our”) and you (“Client” or “you”) for all services we provide. By requesting a quote, scheduling a service, or authorizing work to proceed, you agree to these Terms.

1. Scope of Services

NWGA Smart Homes provides professional residential smart home installation and technology services in North Georgia, including but not limited to:

  • Smart home automation system design and installation
  • Security camera and alarm system installation
  • Whole-home Wi-Fi and networking solutions
  • Home theater design and installation
  • Distributed audio and video systems
  • Smart lighting design and installation
  • Smart lock and access control installation
  • Outdoor entertainment systems
  • Ongoing technical support for installed systems

Services are provided to residential properties located within our North Georgia service area. Commercial work may be considered on a case-by-case basis. We reserve the right to decline any project at our sole discretion.

2. Quotes and Estimates

Written quotes and estimates provided by NWGA Smart Homes are valid for 30 days from the date of issuance unless otherwise stated. All quotes are based on information provided at the time of the estimate; final pricing may change if scope changes, site conditions differ materially from expectations, or additional work is required to complete the project safely and correctly.

Estimates are not binding contracts. A project begins only when both parties have agreed to a written quote or work order and a deposit has been received (where applicable). Verbal agreements are not binding.

If the scope of work changes after a project begins, we will provide a written change order for your approval before proceeding with the additional work. Change order pricing is subject to our then-current labor and material rates.

3. Payment Terms

Deposit

For projects with a total value of $500 or more, a deposit of 50% of the project total is required before materials are ordered or the project is scheduled. The deposit is applied toward the total project cost.

For projects under $500, full payment may be required upon completion at our discretion.

Balance Due

The remaining balance is due upon completion of the installation or service visit, prior to our technician leaving the premises, unless alternative payment arrangements have been agreed to in writing.

Accepted Payment Methods

We accept cash, check, and major credit/debit cards. A convenience fee may apply to credit card payments on larger invoices; this will be disclosed at the time of invoicing.

Late Payments

Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend warranty service for accounts with unpaid invoices.

Returned Payments

A $35 returned check fee will be added to any invoice paid with a returned check.

4. Client Responsibilities

To ensure a successful installation, you agree to:

  • Provide accurate information about your home, existing systems, and project goals during the estimation process.
  • Ensure that our technicians have safe and unobstructed access to all work areas on the scheduled service date.
  • Ensure that existing electrical, network, and structural conditions meet reasonable standards for the planned work. Additional work required to bring conditions up to standard may result in additional charges.
  • Be present or designate a responsible adult (18+) to be present during the installation and customer walkthrough.
  • Follow manufacturer guidelines for the operation and maintenance of installed equipment.

5. Cancellation and Rescheduling

We understand that schedules change. Please notify us at least 48 hours in advance if you need to reschedule or cancel a scheduled appointment. Cancellations with less than 48 hours’ notice may result in a trip charge or forfeit of the scheduling deposit.

If you cancel a project after materials have already been ordered on your behalf, you may be responsible for restocking fees or non-returnable materials costs.

6. Warranty

Workmanship Warranty

NWGA Smart Homes warrants our installation workmanship against defects for one (1) year from the date of project completion. If a defect in our workmanship is identified within the warranty period, we will correct it at no charge.

The workmanship warranty covers labor only and does not cover:

  • Damage caused by misuse, abuse, unauthorized modifications, or failure to follow operating instructions.
  • Damage caused by power surges, lightning, flooding, or other acts of nature.
  • Issues caused by changes to the home’s structure, electrical, or network infrastructure made after our installation.
  • Normal wear and tear.
  • Equipment and hardware covered under manufacturer warranties.

Equipment and Hardware Warranty

All equipment and hardware we install is covered by the respective manufacturer’s warranty. Warranty terms vary by manufacturer and product; we will provide you with manufacturer warranty documentation for equipment installed on your project. We will assist you in filing warranty claims for equipment failures that occur within the manufacturer’s warranty period, but we are not responsible for manufacturer warranty decisions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, NWGA Smart Homes’ total liability to you for any claim arising out of or related to services provided shall not exceed the total amount you paid to us for the specific project giving rise to the claim.

In no event shall NWGA Smart Homes be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or property damage not directly caused by our installation work, even if we have been advised of the possibility of such damages.

We are not responsible for pre-existing conditions, defects, or code violations in your home that are discovered during our work. We will bring such issues to your attention; correcting them is your responsibility.

8. Third-Party Products and Services

Smart home systems rely on third-party hardware manufacturers, software platforms, and cloud services (such as Google, Apple, Amazon, Samsung SmartThings, and others). We are not responsible for changes, outages, discontinuation, or limitations imposed by these third-party services. We will work to provide solutions when platform changes affect your system, but such work may be billed at our standard service rates.

Internet connectivity is required for most smart home features. We are not responsible for internet service outages or speed issues from your internet service provider.

9. Intellectual Property

All content on the NWGA Smart Homes website, including text, images, graphics, logos, and other materials, is the property of NWGA Smart Homes or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our website content without express written permission.

10. Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter informally by contacting us at info@nwgasmarthomes.com. We will make good-faith efforts to resolve disputes promptly.

If informal resolution is not successful, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings to be held in the county in which the services were performed in the State of Georgia. The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Georgia.

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. When we do, we will update the “Last Updated” date above. Continued use of our services or website after such changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
